For unrestricted reports,
include the following paragraphs:
We have requested the following records from the Department of Defense:
DD Form 2910, Victim Report Preference Statement,
or similar form, and/or
sexual assault forensic examination (SAFE).
If you have these records in your possession, please provide us with copies. If you don’t have the records,
you may obtain copies of them by contacting the Sexual Assault Prevention and Response Office (SAPRO) at the military base
where you filed your report.
Be sure to specify a time limit of 30 days for the claimant to furnish evidence, and:
advise the claimant that if evidence is not submitted
within 30 days, VA may decide the claim based on all the information and evidence in the file, and
inform the claimant that he/she has one year from
the date of VA's request to submit any evidence or information to substantiate the claim.
If the Veteran indicated that the report was unrestricted, develop for the records to DoD immediately.
Be sure to develop for all evidence necessary to make a decision.
If the Veteran submits a copy of the DD
Form 2910, ensure that it is signed by the Veteran and either the SARC or Victim Advocate. Original copies of the form
are not required, unless there is reason to question its validity. When the copy of DD Form 2910 is not signed by the
SARC or Victim Advocate, develop to the Veteran for VA Form 21-4142 and follow the procedures outlined in the section below.
Important: DD Form 2910 must be signed by both the Veteran and either
the SARC or Victim Advocate.
