VA Compensation Takes Time
(Continued from Page 1) "I request a de Novo review. In general usage, de novo is a Latin expression meaning "from the beginning,"
"afresh," "anew," "beginning again." Thus administrative decisions may be reviewed on a de novo
basis. So I am asking for a different person than the one who made the original decision to reconsider the case."
I had a QTC exam completed in Bakersfield, California and in the exam the doctor stated that I seem not to have any
pain or my posture was normal gait, check out this website. (http://library.med.utah.edu/neurologicexam/html/gait_abnormal.html)
What is pain? Pain, in the sense of physical pain, is a typical sensory experience that may be described as the unpleasant
awareness of a noxious stimulus or bodily harm. Individuals experience pain by various daily hurts and aches, and sometimes
through more serious injuries or illnesses. For scientific and clinical purposes, pain is defined by the International Association
for the Study of Pain (IASP) as "an unpleasant sensory and emotional experience associated with actual or potential tissue
damage, or described in terms of such damage".
Most people with pain have good days and they have bad days! The day that I had my QTC exam happened to be a good day
for me. My whole VA claim was decided on what I consider a good day. That is unacceptable. It also states in the denial letter
a 20% evaluation is not warranted unless X-ray evidence shows involvement of two or more major joints or two or more minor
joint groups with occasional incapacitating exacerbations. When were they going to do X-rays of my joints or MRIs to justify
this decision?
