Does anyone know a good claims Atty. in the Encino, CA area?


A1:   Why do you want to give an attorney all of your money. They can't do anything for you that a veteran service officer can't do. Save your money! See the DAV or VFW.  (AP)  4/18/2016

A3:  I have to agree with the statement above.  I am an accredited VSO in NC.  I see veterans every week who have FIRED their attorney because they take their money and do not provide services.  Unfortunately, once you sign a contract with an attorney, you will probably loose your money regardless of firing them.  (RJ)  4/26/2016

Is a WW2 widower eligible for VA benefit?


A1:   That depends on several factors. You have to know the characterization of your husbands discharge, his period of service, and what benefits the widower is claiming for. I suggest that she seek assistance from a veteran service officer. I recommend the local DAV chapter.  (AP)  4/18/2016

A2:   This is a loaded question and there is a lot of information a good veteran's counselor needs.  First we need to know if your spouse had a service connected disability.  If she did was that disability the reason or one of the reasons for her death?  If it was you may be eligible for Dependency Indemnity Compensation (DIC) which is around $1,200 per month.  You will need to file a 526EZ with a copy of the death certificate.  Second if your spouse was 100% service connected for more than 10 years and you meet the marriage criteria you would be eligible for DIC no matter the cause of death.  Nest issue is what is called the War Time Pension.

The deceased Veteran must have met the following service requirements:  For service on or before September 7, 1980, the Veteran must have served at least 90 days of active military service, with at least one day during a war time period.  If he or she entered active duty after September 7, 1980, generally he or she must have served at least 24 months or the full period for which called or ordered to active duty with at least one day during a war time period.  Was discharged from service under other than dishonorable conditions.  Survivors Pension is also based on your yearly family income, which must be less than the amount set by Congress to qualify.  It is difficult to answer the question without any more information than the question.  Most of what I've provided is based on best case scenario.  Good luck and we will always honor your spouse's service.  (CP)  4/19/2016
