Question #59

I have a claim in appeal process. I was stationed at Anderson AFB Guam from Oct 68 to Jan 1970. While there I went to Cameron Bay South Vietnam the last week of Oct 1969 first week of Nov 1969, went back to Guam and was processed out honorably discharged Jan 1970. I was paid while in Vietnam. I have requested my pay records but was told the VA does not have any record of my pay records. I have made my claim in April 2013. My question, How can I prove I was in Vietnam without orders?

A1:  If you were Army, contact Ft Knox Ky. A lot of records are now there. There is also a repository in Ft Meade Md. If you need further info contact me. There are spots in Vietnam that are under another code.  (RSV)  5/20/2016

A2:  Check with the National Archives they should be able to find your pay records I not sure weather they will charge you a fee or if you have a lawyer I would ask him to get it that's what I had do to prove that I had been in Da Nang Harbor aboard one of my Commands.  (HAA)  5/20/2016

A3:   I had the same problem I had gone to nam m times and no orders I found a friend of mine who was there and he sent a mail to me which I gave to the va and it worked.  (LB)  5/20/2016

A4:   What I would do is get 2 or more notarized statements/letters of soldiers you served with relating the fact and dates when you were in country.  Keep the originals in a safe only give them copies. 2 will work but 3 or more is better.  (TAP)  5/20/2016

A5:  I have a similar problem. I was TAD (USN) from Yokuska, Japan to Cam Ron Bay during 1968 for 3 weeks. Although my DD214 lists a Vietnam Service Medal, I cannot find any TAD orders to beef up my claim should I have to apply to VA. You might want to contact your command in Guam to make a correction to your DD214. I hope this helps.  (FG)  5/20/2016

A6:  There should be a paper trail of some sort giving you permission or ordering you to be in Viet Nam. If not then technically you were AWOL and that case you will have a hard time proving you were in Nam. Letters from people you went with or you were with while there may help.  (DJB)  5/20/2016

A7:  Without any thing on your DD214 you might be out of luck.  (JB)  5/20/2016

A8:   Without your orders, you would need a statement from someone that was there at the time, a picture of you in country, or something of that nature. Without any of this, your claim will be hard to prove. Have you tried to send for everything in your military personnel file just to see if there is any mention of Vietnam in there?  (AP)  5/20/2016

A9:   Get your records from St Louis records folks, or get sworn statements from people who were with you.  Any thing that you sent from Vietnam to someone while you were in country.  None of this may work, but try anything.  Usually the VA wants a document of some sort.  I think there might be a lawyer who specializes in this type case.  Also most states have some sort of veterans assistance people.  Hope this helps.  (BK)  5/20/2016

A10:  Contact the Army Record Center in ST. LOUIS, MO. Having no orders  to  report for duty in Vietnam is going to be a problem but the record just might be able to help you.  (LMR)  5/20/2016

A11:  If you were short term there should be a separate w-2 with the pay on it with non taxable. Hazardous duty,  imminent danger,  combat etc. Upper right box on w-2.  (GS)  5/21/2016

A12:  Your DD214 will show all duty stations whether TDY or permanant. This will prove your time in Vietnam.  (CS)  5/28/2016

A13:  The VA does not hold any pay records.  These would be held by the DOD.  Do you have a flight ticket or manifest? Did you take any pictures while you were there?  These could be used as evidence.  (RJ)  6/14/2016

A14:   The Recirds Center will only have an abbreviated version of your SErvice Records. Chances are they will not have your medical records. To get everything, you need to request them from the branch of service you were in. You contact their Personnel Command. In the link below are their addresses and phone numbers.

Question #60

I am rated at 100% disability through the VA.  My eldest Daughter is 27 and plans to start her Masters Degree next summer (2017).  Does she qualify for any VA Programs to help her with her Post Graduate studies?

A1:  Talk to your VSO-VETERAN SERVICE OFFICER.  (TAP)  5/20/2016

A2:   Unfortunately, No. Her eligibility for education benefits under Dependents Educational Assistance ended at 23.  (AP)  5/20/2016

A3:  After the age of 23 you get a big fat  zero. Oh by the way the veteran needs to be 100 %total and permanent.  (PG)  5/23/2016

A4:  Unfortunately, the simple answer is NO.  However, some states have scholarships for children of disabled veterans.  (RJ)  6/14/2016

A5:  It all depends when you were granted 100 P and T with Chapter 35 benefits. In my case my daughter was 24 at the time of my award. She was given 8 years to use her Chapter 35 benefits; spouse 10 years. My daughter's eligibility expired at age 32. If a child has not exceeded age is 26 they are eligible, not age 23.
