I have been turned down from the V.A. disability for my back problems.  I have a degenerate disease stenosis, arthritis, 7 steel rods and multiple screws.  I’m receiving disability\SS. I was a tank mechanic from 1977-1980 for the U.S. Army.  My letter from the V.A. says "While your service treatment records reflect complaints, treatment, or a diagnosis similar to that claimed..." they denied my request for help not sure what to do next. Help!


A1:   You need your Orthopedic physician to write a Nexus letter stating that your condition is service related and to provide the proper diagnosis as the same you received in the military then file a reconsideration or request a DRO review.  (PW)  6/2/2016
 
A2:  Love claims like yours.  I get lots of them, but you need to get the Notice of Disagreement filed based upon the failure to provide the benefit of the doubt.  Then get a Veteran Service Officer.  (CKP)  7/30/2016

Which form do I submit to the VA to make a claim for PTSD? I submitted one, but they informed me it was the old form.


A1:  You file a claim with VA form 21-526 or do it on line through Ebennefits with 21-526EZ.  (PW)  6/2/2016

A2:  I would recommend filing the 21-526EZ as a fully-developed claim. Include any and all doctor statements, medical records pertaining to current treatments, and include the 21-0781a (dtd 5/2015), and/or the DBQ 21-0960P-3.  (AP)  6/6/2016

A3:  You should also complete a 21-0789 Stressors Form to get a jump on the system.  (CKP)  7/30/2016
