Long
story short, I was rated 60% all together for issues and injuries in Iraq. Yet now I have recently found out that I have degenerative
back disease because of my injury to my back while in the Marines. Sometime last
year, I was rated 80% for a month and then the military or VA thought my back issue was unrelated to my military service. It's become so bad that even at my job where I stand for over 8 hours, I have
to take Prednisone for the pain and be able to stand or even sleep. I have to started steroid injections soon just to walk
or function properly. I am wanting to increase my rating but
I am afraid that the VA will deny it and cause my 60% rating to fall.
This issue I am having is that since I cannot breath through my nose, they said that
it didn't fall within the range for benefits. I haven't been able to breath correctly since Iraq in 2008.
My migraines stop me from coming in to work some days or make me
go home early so I wanted a re-evaluation for those.
Lastly,
the biggest issue of all is my back which I was rated 20% but that is the worst of them all aside from my PTSD and migraines.
I would like counseling on what I should do from here to get a higher rating. I have
documents updated about my back, with procedures, medication, and X-rays. Please let me know if you can help or at least point
me in the direction to be helped.
A1: There seems to be not a enough information
to give you an answer. In part a need to explain why you were at 80% for one month. Was this a temporary rating
due to some procedure or did the VA send you a letter stating they mad a Clear and Unmistakable Error (CUE. I suggest
getting your Orthopedic doctor to write a Nexus letter connecting your degenerative back disease to your back injury.
Then consult a VSO to help you in greater detail. (PW) 6/2/2016A2:
You have a lot of potential in your claim. But, you need to get a Veteran Service Officer or County Veteran Service
Officer to review your Service Medical Records, your military records, and the VA records. Lots of potential.
