I am now a 50% disabled Vietnam Vet. I just read your article about Pleurisy, which I have had ever since I got out of the service in 1970. Also, I have Hemorrhoids, and Plantar Fasciitis, spur on my right heel.  Since I am already 50% disabled, if I filed for any of the above how much proof do I need and would it take away from what I am getting now?

 


A1:  The VA can reexamine any veteran regardless of their status any disability not held for 20 years. This does not mean your current disabilities will be reduced. The VA must go through a lengthy process to reduce a rating. The most used reason is a veteran has significant improvement in a condition. However, there are limits to how this is determined. How long have held a rating, age such as being over 55, and if it was gained by fraud.   As to your present claims see a VSO and collect medical records or be evaluated for these conditions.. My golden rule before you file claims is to get your C-file and review it.  (CP)  5/28/2016

With 1151 claims, how is it possible to compensate for death claims as it relates to medical malpractice?  How is this compensable if there is a new injury or exacerbation of an existing injury and then the veteran passes 2-3 years later from both the new injury and the exacerbation of an existing injury? With 1151 claims, who can file a claim and/or can the estate file a claim if there is no spouse or children?

 


A1:   A 1151 claim has a 2 years statute of limitations from the date it was noted the person experience malpractice by the VA. My advice is to seek out a veterans attorney in how to proceed.  (CP)  5/28/2016
