PSP Questions

Question #49

I was awarded "Parental Kinship" over my three grandchildren. Are they (or) myself entitled to any form of compensation through the VA?

A1:  For the purpose of dependency, grandchildren do not qualify, even if they are adopted.  (AP)  4/25/2016

A2:  You need to send the appropriate form to the Regional Office so they can make a determination. The VA would increase your compensation as dependents.   I would advise seeing a VSO to help you with this claim.  (CP)  4/25/2016

A3:  Your grandchildren will not be recognized by the VA until you officially adopt them.  (RJ)  4/26/2016

Question #50

I am a Vietnam vet. I had prostate cancer in 2006 did not file until 2012. I had not kept up with anything related to agent orange.  Is there anyway I can get  compensated for the years I missed?

A1:   Unfortunately, no. The regulation states that the date of claim will be the date that the condition was diagnosed or the date of the initial claim, whichever is LATER!  (AP)  4/25/2016

A2:  You would have to file a claim with the VA and request a date of claim. In other words you are asking the VA to consider a date of disability in 2006 and request retroactive pay from 2006.  (CP)  4/25/2016

A3:  Yes,  contact your County Veterans Service Office,  they are the best.  Do not use the Veterans Service Office in the VA facility,  it has been my experience that they are lazy. (LT)  4/26/2016

A4:  The VA will only go back to the initial claim date.  (RJ)  4/26/2016
