I was told that anyone with a Mood Disorder disability that is on medication and receives VA Benefits, must subject to Urine tests periodically and also live in an ALF or Nursing Home.  Is that true?

 


A1:  Absolutely false!  VA will however re-evaluate you unless you are rated totally and permanently 100% disabled.  (TH)  7/7/2016
 
A2:  TH is partially right on his answer.  But, there are a few things that aren't known.  The question would be what kind of medication are you on?  If they are class A drugs then you could be subject to urine tests if you are also in pain management.  It is difficult to make a spot suggestion/answer with limited information.  TH could be 100% correct but his answer is based upon the diagnosis that was provided.  Otherwise depending on the medications it may be possible that you would be subjected to urine testing.  (CKP)  7/29/2016

I filed for Aid and Attendance on 6.15.15 and have a file date. Now Regional says that there is not the required form 21-2680 that has to be filed. This is the only form that needs to be filed for this claim. I believe that when originally filed it was in the old system V V A system and when changed on 7.31.15 the VA doesn't know to look there. I have told them again when filing form 214-4138 with my VSO Officer on 4.5.16 to look there and process my claim. They don't seem to get it. What can I do? 


A1:  What you need to do is submit the requested form. The original form may have gotten misplaced or misfiled. Do you have a copy of the original form that shows the date that you submitted it? Did you submit the form directly to the VA or through a VSO. This is why I don't recommend that my clients send anything directly to the VA. If it were sent through the VA, they would have a copy that would have a time stamp when they received it.  (AP)  6/25/2016

 

A2:  AP is correct, but if you also had submitted it by USPS Return Receipt that would suffice along with a 21-4138 from your VSO stating that they had submitted the correct form if the VSO had submitted the form.  But, the first thing you need to do is to file the form they are asking for and get the claim granted.  Then you file a Notice of Disagreement (NOD) for the effective date of award.  (CKP)  7/29/2016
