Question #51

I currently receive SMC (S) for my heart and PTSD.  My question is if I file a claim on my benign prostate hardening and I was to receive K would that be in addition to my smc (s) rating?

A1:  The VA should automatically give you Special Monthly Compensation if you qualify for it. You do not have to apply. If, however, you feel that you qualify and you are not receiving, contact your local Veteran Service officer.  You can learn much more about SMC here.  http://www.militarydisabilitymadeeasy.com/specialmonthlycompensation.html  (RJ)  4/27/2016

A2:   The only issue is that with a benign prostate hardening you will not be service connected for presumptive conditions of Agent Orange.  But, I would check with my cardiologist and psychiatrist/psychologist to see if they can determine that you have erectile dysfunction secondary to the heart condition or heart condition medication and/or also related to PTSD.  If the doctors indicate that a ED condition (not the prostate)is secondary to the other two conditions (or even one of the conditions) then the VA could award you a 0% rating with an SMC (K).  But be aware that the VA will probably try to say that the ED is caused by the benign prostate hardening and you would have to appeal based upon the condition being secondary to other service connections.  (CP)  4/30/2016

Question #52

How do I file a claim for the $20,000?

A1:  I have heard this question multiple times recently. There is no such thing as a $20,000 payment. This is a myth.  (AP)  4/27/2016

A2:  I was told on another page that Chris Gibson (R NY) had introduced a bill into Congress to compensate veteran's for the loss of a creative organ with two payments of $10,000.00.  I will look it up, but it's just a proposal and is nowhere in law.  The only thing available for ED (Loss of Creative Organ) for a mail veteran is a 0% rating with an SMC (k) of $103.23 per month.  (CP)  4/28/2016
